दोस्तों याद कीजिए, कुलभूषण जाधव से संबंधित याचिका अंतरराष्ट्रीय न्यायालय में विचाराधीन है. इस याचिका के आधार पर न्यायालय ने पाकिस्तान के सैन्य न्यायालय द्वारा जाधव को दी गई फांसी की सजा पर स्टे लगा दिया था.
अंतरराष्ट्रीय न्यायालय में कुल मिलाकर 15 स्वतंत्र न्यायाधीश होते हैं. हर न्यायाधीश का कार्यकाल निश्चित 9 वर्षों का होता है. हर 3 सालों के बाद में 5 न्यायाधीशों के लिए चुनाव होता है. इस चुनाव में जीत का निर्णय संयुक्त राष्ट्र संघ की आम सभा और सुरक्षा परिषद में हुए अलग-अलग चुनावों में बहुमत के आधार पर किया जाता है. कृपया ध्यान दीजिए, कि किसी भी राष्ट्र को इस बात का अधिकार नहीं है, कि उसका न्यायाधीश अंतरराष्ट्रीय न्यायालय में शामिल हो. फिर भी ऐतिहासिक रूप से हमेशा इस न्यायालय में संयुक्त राष्ट्र की सुरक्षा परिषद के 5 स्थाई सदस्यों की तरफ से 5 न्यायाधीश इस न्यायालय में शामिल रहे हैं. इस साल हो रहे चुनावों में, 4 न्यायाधीशों का चुनाव बड़ी आसानी से हो गया, लेकिन अंतिम 5th न्यायाधीश का चुनाव भारत की तरफ से दलवीर भंडारी और ब्रिटेन की तरफ से Christopher Greenwood के बीच फस गया है.
11वी बार हुए मतदान के अनुसार भारत के उम्मीदवार को राष्ट्र संघ की आम सभा में लगभग दो तिहाई बहुमत मिल चुका है. क्योंकि ब्रिटेन संयुक्त राष्ट्र सुरक्षा परिषद का स्थाई सदस्य है, इसलिए उसके उम्मीदवार को सुरक्षा परिषद में बहुमत के 9 मिले थे.
यह संयुक्त राष्ट्र संघ इतिहास में पहली बार हो रहा है, कि सुरक्षा परिषद के किसी स्थाई सदस्य देश के उम्मीदवार को संयुक्त राष्ट्र संघ की आम सभा में बहुमत प्राप्त नहीं हुआ है. पहले तो उन्हें बड़ी आसानी से अंतरराष्ट्रीय न्यायालय में पहुंचने का मौका मिल जाता था.
रोचक बात यह है, हर बार आम सभा में हुए मतदान में भारत के उम्मीदवार का मत प्रतिशत लगातार बढ़ता आया है. इसलिए इस बात का सवाल ही नहीं उठता, कि भारत अपने उम्मीदवार को इस चुनाव में पीछे हटा ले. वास्तव में, भारत की सरकार ने अपने उम्मीदवारों को जिताने के लिए पूरी कूटनीतिक ताकत झोंक दी है.
इसलिए महत्वपूर्ण सवाल यह उठता है, कि कब तक संयुक्त राष्ट्र संघ की आम सभा के बहुमत की आवाज को दरकिनार किया जा सकता है, यदि वह सुरक्षा परिषद की बहुमत की आवाज का समर्थन नहीं करती है. वास्तव में, आमसभा ही संयुक्त राष्ट्र संघ का प्रतिनिधित्व करती है.  इसलिए आमसभा के बहुमत की आवाज सुरक्षा परिषद की तुलना में ज्यादा महत्वपूर्ण होती है.

लेकिन बहुत लंबे समय से ब्रिटेन को अपनी ताकत का घमंड था, इसलिए वह भी अपने उम्मीदवारों को पीछे नहीं हटा रहा है. उन्हें यह बात बचाने में बड़ी दिक्कत होगी, कि उनके उम्मीदवार को संयुक्त राष्ट्र संघ की आम सभा में बहुमत प्राप्त नहीं हो पाया है.
यही कारण है, कि 11 बार  मतदान होने के बावजूद भी बातचीत से रास्ता नहीं निकल पाया है, और अब आज 12 वी बार  का मतदान होगा.
सुरक्षा परिषद के पांच सदस्य अपना एक विशिष्ट गुट बना लिया है, और उन्होंने वर्षों से लगातार सुरक्षा परिषद में होने वाले हर संभव सुधार को होने से रोका है.  इसलिए सवाल अंतरराष्ट्रीय न्यायालय में एक न्यायाधीश का चुनाव जीतने का नहीं है. इसलिए वक्त आ गया है, संयुक्त राष्ट्र सुरक्षा परिषद के पांच स्थाई सदस्यों को बदले हुए वैश्विक परिदृश्य में, विकासशील और अविकसित देशों की शक्ति से परिचित कराया जाए.

Now Lets discuss about today's topic.
Please recall, a case  involving Indian National Kulbhushan Jadhav is pending in International Court of Justice, Which has granted stay on his death sentence, ordered by Military court in Pakistan.

International court of justice has total 15 Judges.  Each judge has term of 9 years.
For purposes of measuring continuity, 5 judges of the court are elected every three years.

These judges are elected by separate majority vote in both United Nations General Assembly and Security Council.
Please note, No country has right to have its judge always in International court of Justice.  However as per historical practice, the court has always included one judge from each of the permanent member of security council.

This year, four candidate have been smoothly elected. but the interesting election for the last seat is being fought in between Indian candidate Dalveer Bhandari and British candidate Christopher Greenwood.

In 11th round of voting, Indian candidate has got close to two third majority in voting happened in UN general assembly.
Since Britain is a permanent member of security council , British candidate has got majority 9 votes in security council.

This is for the first time in the history of United Nations, a candidate from permanent member of security council member country has faced challenge in getting easy pass to international court of Justice.

Interestingly, In each of the 11 rounds, support for Indian candidate in General assembly has grown steadily.
Hence, there is no question for India to withdraw its candidate from the race.
In fact, Indian government has gone all out to garner support for its candidate in General assembly.
The Important question is, if the majority voice of general assembly can be ignored only because its not supporting the permanent member of security council.

Moreover, its general assembly, which represents the united nations. Hence, its voice carries more weight than the voice of Security council.

But its the sense of British entitlement, due to which British candidate is also not withdrawing.  Its going to be very hard for them to digest, their candidate could not garner support in General assembly.

That's why negotiation have failed to break the deadlock and 12th round of voting is to happen today.

These permanent five members of exclusive group has consistently prevented any reform in the security council.
Hence, its not about winning the election for a seat of a judge in international court of justice, time has come to make them realize the power of developing and undeveloped world.
