You all know about Rafael controversy. Lets look at quick time line.



On 23 September 2016, more than 2 years ago, India and France signed an inter governmental agreement for the acquisition of 36 fighter jets.



On the very next day, Doubting the escalation of per aircraft cost, Congress asked for agreement details to be made public.



But in order to attract public attention, there is always a need for complete controversial story.



In November 2017, Congress alleged that procurement procedure were by passed in the acquisition of Rafal fighter jets, and Reliance defense was dragged to spice up the story.



While the controversy has been kept alive, Supreme court agreed to hear first P I L on staying the Rafal Fighter jet deal between India and France on September 5, 2018.



 Now the basic question arises, why it took around 2 years for someone to file P I L in this case of massive corruption.



Since congress has so many eminent lawyers , why it didn't ask anyone of them to file a P I L in Supreme court.



Now, look at this, Congress said, it would first wait to get all the necessary documents before moving to the court on the matter.



That's fine, congress can wait as long as it wants.



But if getting document was so much necessary, the P I L petitioners have been found to be more efficient than congress.



You see, In September Supreme court started hearing of the P I L and this week petitioners will be handed over all relevant procedural documents.



Now, should we assume that legal brains of congress are so foolish, that they didn't know how to get easily and quickly documents from government?



The possibility is, they knew how to get the documents, the problem is they did not want to get the documents.



If controversy is beneficial to you, why would you try to kill it by getting the details.



Amid all this, everyone was interested to know the pricing details of Rafel jet deal.



Its understandable that curiosity of human mind cannot be limited by the consideration of national security related interests.





Despite having full knowledge of secrecy pact in between India and France, the public disclosure of pricing details has been asked again and again.



Government of the day should not violate the international agreement signed by earlier government, because if each government starts breaking the secrecy pact signed by previous government, no country will enter into secrecy pact with India.



Its the situation, in which expert will condemn government if it reveals the pricing information, and will also condemn if it doesn't reveal the pricing information and raise suspicion, why such details are not being shared.





Moreover, even if Pricing details are divulged in the public, every one would have been free to interpret it. But our adversaries would have certainly interpreted it correctly to their strategic advantage.



In India, we frequently see, a court verdict is delivered and both parties claim equal victory.



Therefore it was naive to assume that controversy would have died down, even if Modi government had placed pricing details in public.





Here again, every one was seeking the pricing details, but no body really wanted to know the truth.



In fact, Most honest person in our country, who has made P I L as very good revenue generating source had to meet senior government official to get the idea. if he really wants an investigation in Rafael Jet controversy, he should file a P I L in the supreme court.



That's how the matter reached the court and it was widely publicized in the media that now Modi government will have to face the investigation in Rafale jet deal.



When Supreme court asked for all the procedural and pricing details from central government, the signs of happiness were clearly seen on their faces.



Perhaps they forgot, Prime Minister Modi builds staircase by the bricks thrown at him.



Now, you know, contrary to general expectation, Modi government has shared all details with supreme court.



Now, supreme court judges will be able to examine the pricing details.



Basically, P I L in supreme court has turned out to be great opportunity for Modi government.



Without violating the secrecy pact with France, Now independent supreme court can go through pricing details and smell any corruption there.



With access to full procedural details, P I L petitioner can highlight the violation and seek further probe.



Needless to say, Investigation in Rafael jet deal will take much longer time, but by means of this P I L supreme court can identify, if there is prima facie corruption case against modi government.



If all procedures have been followed, the court may well say there is no need for further investigation.



We don't want to prejudge what supreme court will say in this matter.



But the point is different, if Supreme court order filing of an F I R and starting investigation, it would be considered a big victory for P I L petitioners.



However in case, Finding no preliminary evidence of corruption, if Supreme court quash the P I L itself, please dont expect petitioners and congress to accept the defeat. They will be ready next day with their set of allegations against the judges of supreme court.



The matter is sub judice, but media has already started casting doubt that modi government has not shared all details with the court.



It would be better, After reading these opinions in news papers, P I L petitioner come up with compelling argument before the court.



Newspapers editorials cannot pass judicial orders, therefore they should leave the work of justice to courts.



For now, P I L at supreme court has provided the level playing field for both parties to put forward their best argument with all information available with the judges.



Now, rather than taking sides, it would be better for us to wait and watch the court proceedings.



but by sharing all details with supreme court, Modi government has effectively turned an adversity into an opportunity to come conclusively clean.



P I L petitioners must be congratulated for unknowingly putting government of India to fire test.



Else there were only allegations and counter allegations wasting time of the whole nations.
